REASONABLE ACCOMMODATION TO ENHANCE THE EMPLOYABILITY
AND RETENTION OF PERSONS WITH DISABILITIES POLICY

PURPOSE

To outline the means by which West Virginia University will consider reasonable accommodations in accordance with the Americans with Disabilities Act, the West Virginia Human Rights Act, the Federal Rehabilitation Act of 1973 and the West Virginia University Affirmative Action Plan.

SCOPE

This policy applies to all University employees and applicants, including those on the regional campuses.

POLICY

The University will follow applicable Federal and State guidelines and statutes as they relate to reasonable accommodation of individuals with disabilities and their capabilities to perform essential job duties. Investigation into reasonable accommodation options for persons with disabilities will involve initial input by, but not limited to, the Director of Human Resources, a University Health Service physician and/or the individual's physician, the unit supervisor and the individual. To this end, the University will analyze and respond to each medical situation on a case-by-case basis using the most current evidence available.

PROCEDURE

Additional information regarding this policy or the proper procedure to follow can be obtained in the Reasonable Accommodation to Enhance the Employability and Retention of Persons with Disabilities procedure.

RESPONSIBILITY FOR IMPLEMENTATION

The immediate supervisor in conjunction with appropriate University administrators is responsible for determining if an employee’s functional limitations can be accommodated. The Social Justice Office in the President’s Office or the Employee Relations Units in the Department of Human Resources, at 293-9232 or 293-5700 respectively, is available to answer questions or provide additional information regarding this policy.

RESPONSIBILITY FOR INTERPRETATION

The responsibility for interpretation of this policy rests with the Director of Human Resources, West Virginia University.
