for the WVU SRC in Morgantown, West Virginia

Payment for Personal Property: Payment in full at the conclusion of auction in cash, Certified funds, and/or travelers checks. Personal or Company checks will only be accepted when accompanied by a valid Bank Letter of Guaranteed Payment. Letter of Guarantee MUST be written word for word as follows on bank's letterhead. Mr. or Ms. is a customer of our bank and we will guarantee payment of checks written on his/her account up to: $_________ (specify maximum amount) dollars for purchase at your auction. All checks MUST be made payable to: Diversified Marketing Inc. No merchandise shall be removed until paid for in full. All personal property must be removed immediately. All sales items left at the University location after the removal time frame will be subject to a storage fee of 20 percent of the lot sales price, after 5 days the lot is forfeited to the University. Purchaser is responsible for any equipment necessary to affect removal of a purchased item. Purchaser is responsible to landlord for damages as a result of removing items purchased. Titles will be held for any items paid for by a company or personal check. WVU reserves the right to add or delete items as needed.

The Personal Property will be sold "AS IS" "WHERE IS" and there are no representations or warranties, expressed or implied, including but not limited to, any expressed or implied warranty of merchantability, fitness, or for any other purpose, as to any property or improvements to be sold.

Purchaser does hereby indemnity and hold harmless, Auctioneers and/or Corporation from any and all damages, claims or liabilities from injuries to persons or property of any type, whatsoever, caused during the auction sale, or by the removal of items purchased.

If any dispute arises between two or more bidders, the Auctioneers and/or Corporation, at their sole option, may put the Personal Property up for sale again at once and resell to the highest bidder.

To maintain the continuity of the sale, it shall be the duty of the Auctioneer to advance the bidding at his discretion, and may reject a nominal or fractional advance, should it, in his estimation, prove injurious to the sale.

Property is open to thorough public inspection, and it is the bidder's responsibility to determine condition etc..

A bid by any person shall be conclusive proof that the person has made himself or herself acquainted with all these conditions of sale and has agreed to be bound by them.

Seller reserves the right to offer the property as an entirety, piecemeal, or in any other manner deemed practicable in the order to obtain the most advantageous price.

Buyer agrees to pay any and all charges and expenses incurred by reason of any breach of terms and conditions of sale, including, without limitation, reasonable attorney fees.

Purchaser is responsible for all purchases and loss for any reason whatsoever.

Purchaser must have a receipt to remove merchandise from this location. Only the original purchaser will be recognized.

All bid pooling, noncompetitive agreements, etc. is a violation of the Sherman Anti Trust Act and will be reported to the Department of Justice.
