This is an action to value a piece of property for eminent domain purposes. The State has offered to pay $100,000 for a parcel of farm land which lies in the right of way for a widening of a part of U.S. 250 between Fairmont and Elkins. The land owner is contending that the land is worth $200,000 because it is the potential site for a gas station/mini mart in the area. For the land owner proponent will call F.L. Worth whose credentials and report appear in the attachments below. Witness Worth, if permitted to do so, will testify that the property is suitable for building a gas station/mini mark and is worth $200,000. The proponent should lay the foundation which will permit Worth to offer an opinion as an expert and should defend the opinion as necessary. Opponent should object to the credentials and the opinion as permitted by the rules of evidence.
